What are these terms, and who do they cover?

These terms apply when you use this website. Clear Financial LLC does business as Clear Financial Company. "We" and "us" mean that company, and "you" means anyone using the site.

By using the site you agree to these terms. If you enroll in a program, your enrollment agreement sets the terms of that program, and it controls wherever it differs from these.

Is anything on this site advice?

No. Our guides explain how debt, credit, taxes and the law generally work, and they cite the agencies and rules we rely on. They cannot account for your own situation.

We do not give legal or tax advice. If you have been sued, or you have a tax question about forgiven debt, talk to an attorney or a tax professional.

How should you read the estimates?

Figures on this site are illustrations, not offers or guarantees. Results vary; not all debts settle.

Estimates assume creditors settle for 45 to 60% of enrolled balances (typical) or 80% (conservative, a 20% reduction), plus an illustrative fee of 20% of enrolled debt. The actual fee is a percentage of enrolled debt, set individually and charged only after a settlement is reached; your written agreement states it.

An estimate is not an offer to settle any debt, and no creditor has agreed to it.

Does using the site make you a client?

No. Using the site, getting an estimate or calling us does not enroll you or create an agreement. Only a signed enrollment agreement does, after we have explained the program, the fee and the risks to you.

Debt settlement is not available in all states. Clear Financial Company does not offer loans, including debt consolidation loans. We enroll clients in Florida, Georgia, Texas and California only, and that list can change. The details are on licensing and disclosures.

When can we call or text you?

Only when you have asked us to. The estimate form has a consent box that stays unchecked until you tick it, and your consent covers Clear Financial Company only. It is not a condition of any purchase, and you can take it back at any time by any reasonable means (47 CFR 64.1200 (eCFR, opens in a new tab)).

Nothing in these terms is itself consent to be called or texted. If your number is on the National Do Not Call Registry (FTC, opens in a new tab), these terms do not change that, and the Do Not Call rules still apply to us (FTC guide (FTC, opens in a new tab)). To stop contact, reply STOP to a text or call 866-659-7966.

What do you agree not to do on the site?

  • Give information that is false, or a phone number or email that is not yours to give.
  • Try to break, overload or get around the security of the site.
  • Copy the site in bulk, or use its content to mislead anyone.
  • Use the site for anything unlawful.

Who owns the content on this site?

We do, unless a page says otherwise. You are welcome to read, print and share our pages for your own use, with a link back. Please do not present our pages, calculators or design as your own.

The agencies and rules we cite belong to their publishers. Links to them open other websites, which have their own terms and privacy practices, and we do not control them.

What if something on the site is wrong?

We work to keep every page accurate and dated, and we correct mistakes when we find them. If you spot one, call us at 866-659-7966. Laws and program terms change, so a page may sometimes be out of date.

The site is provided as it is. To the extent the law allows, we are not responsible for losses that come from relying on it instead of your written agreement or professional advice.

Which law governs these terms?

The state law that governs these terms, and where any dispute about them would be heard, is being confirmed with our legal counsel. It will be stated here. Nothing in these terms limits a right that the law of your state does not let you give up.

Can these terms change?

Yes. When we change them, we change the date at the top of this page, and the new terms apply from that date. The terms of a signed enrollment agreement do not change unless you agree.
